Laws Creating Monopolies Unconstitutional and Illegal?

The early founders of this nation hated monopolies, they seen the King showing favoritism to the merchant class over the small farmers, and small shop owners in the colonies. They have seen the power of the British Aristocracy engage in anti competitive business practices that favor large corporations that shuts down competition. Monopolies are the most brutal form corporatism I ever seen. The ruthless nature of money and power is a form of economic slavery the founders and framers of the Constitution wanted never to happen again. They have worked to see to it congress cannot legislate crony corporatism.

"No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of one State over those of another: nor shall Vessels bound to, or from, one State, be obliged to enter, clear, or pay Duties in another" Article 1 section 9 the US Constitution"

Can you see the reason why the government is moving to ban home gardens, farmers markets and small family farms? Can you see the pattern of the LA Police along with the sheriffs department attacking a whole foods dealer selling raw milk, unpasteurized cheese and organic vegetable? What about the move to ban herbal remedies to cure chronic and terminal illness. This is not for our safety. This is all these big corporations using the force of government to wipe out any competition.  This shows we have monopoly men running our government. We have lost our republican form of government being replaced with corporate fascism. The merger of government and corporations. That is the true definition of a monopoly



We see government giving preference to Wal Mart, General Electric, Monsanto and other major multinational corporations who write the laws to exempt themselves from taxation. Before the IRS and the 16th Amendment was being up for ratification. The ruling oligarchs set up foundations that exempt themselves for paying taxes while the rest of us are subject to paying an income tax. All the lobbying these corporations writing legislation has killed the manufacturing base in this country. The Federal Reserve System has legal preference in the new laws was under a new financial dictatorship over legal tender laws not allowing a competing currency. The new rules allow them to shut down smaller solvent banks while keeping the mega banks that own the Federal Reserve propped up. The big insolvent banks did not want to compete with smaller solvent banks. The Bankers and Robber barons do not produce anything. Congress is has the duty to see that Americans craftsmen and industrialist were a priority in the constitution as the founding document states.

"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;" Article 1 section 8 of the US Constitution

These free trade deals and allowing Mexican trucks in the country exempt from DOT regulations while restricting the American truck drivers with burdensome rules and regulations. Congress is not promoting innovation and the craftsmen of this country. Our skills out being outsourced to go off shore because corporations lobbied for regulations making it impossible for Americans to produce here and making manufacturing much more inexpensive offshore. Congress has not protected the patents and inventors from industrial espionage. Our government for many years has not promoted the crafts and trades of Americans for many years because they fail to see the danger of monopolies as an enemy to the free market. A monopoly believes in no competition and the economic slavery.

As we look at what is going on today. We have corporatism, which is opposite of a free market economy. These corporations write laws exempting themselves from the rules while making their competitors are under duress to comply with these laws. Tyson chicken can have hundreds of health and safety violations in their plants. While the small chicken farmers can have one violation that is not a safety or health risk, that can be a paperwork error. They can have heavy fines levied against them or be shut down. Big agribusiness wrote the Health and Safety bill to make sure the force of government shuts down their competition that is farmers markets, organic farms and family ranches. These major corporations lobbied congress to give preference over another. This is how they convinced congress to over regulate manufacturing making it expensive to produce products domestically and through free trade deals dropping the tariffs so cheap Chinese goods can flood the US markets making it impossible for US manufacturers to compete when multinational corporations was given an unfair trade advantage. The Founders were against monopolies because they seen the danger of a person's liberties when these corporations use the force of government to shut down competition. The English Colonies suffered at the hand of monopolies before the shot heard around the world. Anyone heard of the East Indian Trading Company?

 

The founders were aware of these Monopolies; they knew how much a threat to economic liberties of the people and the danger they posed. Monopolies just like central banks are more a danger to our liberties than a standing army. Here is what some of the Founders said about Monopolies:

The Anti Federalist Papers 11 stated: The remaining power for peace and trade might perhaps be safely lodged with Congress under some limitations. Three restrictions appear to me to be essentially necessary to preserve that equality of rights to the states, which it is the object of the state governments to secure to each citizen. 1st. It ought not to be in the power of Congress, either by treaty or otherwise, to alienate part of any state without the consent of the legislature. 2nd. they ought not to be able, by treaty or other law, to give any legal preference to one part above another. 3rd. They ought to be restrained from creating any monopolies. -George Mason

 
Our third President Thomas Jefferson was not short on word in his opposition to Monopolies:

 
The selfish spirit of commerce knows no country, and feels no passion or principle but that of gain. Letter to Larkin Smith (1809).

Merchants have no country. The mere spot they stand on does not constitute so strong an attachment as that from which they draw their gains. – Letter to Horatio G. Spafford (17 March 1814)

 
I hope we shall take warning from the example [of England] and crush in its birth the aristocracy of our monied corporations which dare already to challenge our government to a trial of strength and bid defiance to the laws our country. - Letter to George Logan (12 November 1816)

I heard people call me anti free market because I am against monopolies. I am not anti business or anti corporation. I am for fair competition. When laws are written to favor one over the other choosing the winners and losers in commerce. We are denied our right to our pursuit of happiness. Many mining companies back in the early 20th century enslaved there workers under a monopoly forcing them to buy from the company store. They were paid in company script agreeing to buy from the company store and to pay rent. They were not paid in gold or silver were they have a choice to buy from the company store to the merchant in town or pay rent in town or on the mining reservation. As a result, the owner of the mining company charged very high rates at the company store and the cost of living in the mining community was very expensive. The workers were always in debt. This form of a monopoly was used to control the people as long they could never be able to repay the loan because they the boss controlled the debt. Control the debt; he can control the people depriving the people of life, liberty and the pursuit of happiness.

 The only way we can break free from the corporate chokehold is secession of the several states. When the state like Texas forms a new government and has a convention to write a constitution. Corporate law has to be reformed and hard wired in the new State constitution of no private central banks controlling the currency and corporations can only have a charter that served the public interest for a period of time. The state legislature determines if the charter can get an extension for a short time depending on circumstances. The very corporate charter expires after a few short years. This is so a corporation does not become too big having influence in public policy. Corporations have to have a life span when the charter expires. When the corporation is dissolved, assets are liquidated and sold. The money is distributed among the stockholders. If we do not smash these monopolies and break up these entities using anti trust laws and the constitution. We will find these corporations rise up around us depriving our children the land our decedents conquered.


A free market encourages competition. Competing for business keeps companies honest. The alternative media has forced mainstream news sources to compete with us. They are adopting our talking points to maintain what little credibility they have. That is why they want to censor the internet. Competition is healthy and moral. It is not a sin. Monsanto does not want labeling of non GMO foods or milk having no bovine growth hormones notices because it is bad for their business. Businesses will not poison their customers if they are forced to compete in the open marketplace. This is why monopolies are dangerous because the incentive to produce quality products and be accountable to the consumer does not exist. Fair competition is good for the people and bad for the money junkies.  

We are meant to be free and not ruled by oligarchs as Thomas Jefferson seen that we are the real aristocracy and not the ruling class. We defined the new aristocracy which the bankers hated and the elites despised because this quote our third President said is the truth. When we have the freedom to pursue without interference. we become a force to be reckoned with that threatened the despotic rule of the elite. We are the real aristocracy,  not the ruling class or the money junkies. Thomas Jefferson sees we are the true power as was told to John Adams saying"I agree with you that there is a natural aristocracy among men. The grounds of this are virtue and talents."
