13 year old Girl Still in Coma Gets a Ticket for Jay Walking

            I have to say off the bat that this woman should have been looking both ways before crossing the street. We all sometimes like to keep up with our friends . The girl should have been looking before crossing the street and now she is paying the price sustaining injuries in a coma after being struck by an oncoming car in Las Vagas .As a driver who is feeling the jitters hitting someone with their car and having damage for the vehicle. I do not see it as the drivers fault .The 13 year old girl is fighting for her life in a coma for her negligence. I hope the driver and family of little girl can resolve matter without system getting involved.
            To issue a citation for her jay walking I am up in the air about on were the police has a right to issue a citation or not. On one end the girl is living the consequences being in a coma. She is also a minor too and the parent is still are legally responsible for the children. Her ill responsibility not looking before crossing the street probably caused property damage to the motorist's car.Parents have to take responsibility for their children's actions. The girls actions did cause damage to property.
             I just believe it is callous for Police to issue a citation when Mother is having a emotional roller coaster seeing her daughter fight for her life. The last thing she wants to see is the Police issuing a citation for jay walking. I know now police now give tickets for speeding while wife is in labor in the car on the way to the hospital.Police used to help in these situations usually use to make sure you passing through red lights so couple can make it to the hospital. Now I see the Police exploiting every situation to generate revenue.I am torn between both parties. On one hand the daughter is wrong for not looking both ways before crossing the street on the other hand any rational police officer would see the little girl is going through enough punishment already and giving a ticket is not necessary. The owner of the car can resolve paying for repairs with parents out of court. Issuing a jaywalking ticket is a little nonsense is just for revenue. The city was not harmed in any way. This is between the driver and the family of the injured girl in coma. Jay walking ticket is just a stupid citation to issue. If someone gets ran over because they did not look both ways before crossing. Injury is consequence enough.

  1. I doubt that the ticket was intended to simply derive revenue. While I feel terrible for the little girl she did cause the accident and the psychological impact to the driver should not be ignored. That said, in the litigious society of today had the citation not been issued the parents would likely have lawyered up and taken the driver's possessions en masse. I doubt that the amount of the ticket will matter much in the outcome but establishing culpability is necessary and a citation is as good a way as any to assign it.

  3. I agree the ticket is needed to protect the driver. The driver is not always to blame. But without a ticket,to show blame, the parents could/would go after the driver. By her actions she may also have destroyed the drivers life. A 13 year old should know how to cross the street. Darwin award.

As tragic as this situation appears, and as egregious as the jaywalking ticket seems at first glance, I must agree with both Frank and Bladerunner that the ticket establishes culpability and thus protects the driver from any misplaced anger/anguish on the part of the parents. The headline to this article might as well have read: "13 year old teenager jumps in front of moving car; ticket protects driver from lawyers", eh?

  5. A simple incident report filled out by the attending police officer would be sufficient in assigning fault for the incident. Tickets are not issued for every traffic accident to assign blame are they? The jay-walking ticket is ludicrus and irresponsible, the girl and her family are already suffering enough without the completely unneccessary ticket.

  6. They will charge additional fees and possibly issue a bench warrant if she fails to appear in court.

    Though I suppose, if they are responsible citizens meeting your apparent rigor, the family can spend several days mitigating this eventuality.

  7. The one question that comes to mind is the relationship between the driver and the police. Does this person know somebody on the force? Work for the city? This ticket while inappropriate will have minimal effect on a jury, but may intend to deter parents from possible suit.

    Which leads to another point "who pays for the little girls hospital?" If the parents don't have insurance it will be left to the taxpayers, allowing the insurance company a "free pass."

    Is a lawsuit against the insurance company for damages so unjust?

    Remember we don't know all the facts and this might not be as straight forward as it appears, police sometimes give tickets that are later overturned/dismissed by a judge or the state patrol.

    Making a decision based on the headline and not the actual facts of the case is presumptuous and foolhardy.

  8. Unfortunately, ticket issued or not she is a child, and the driver is responsible and it is up to the courts to sort it out. Telling a mother, that her daughter caused a lot of damage to cars and giving her a ticket was unnecessary and wrong. What is going on in the world today?? Earlier this week a man got a ticket for rushing his pregnant wife to the hospital, because she was starting to give birth...I know if I hit a child I would be devastated but, children are not responsible for their actions most of the time and this is one of them. If I were her Mom I would sit and count or video all the people Jaywalking and prove that it is done, and wonders how many tickets are actually written for this. I have a ton of friends that are cops, this ticket issue is ridiculous and he is heartless!

  9. The girl is paying for her inattention with her injuries. The cops being mercenary little shits want the money! Just like the soon to be father who was rushing his wife to the hospital to give birth who got a speeding ticket from the local monkeys. It isn't to protect and serve any more. It's to beat and murder and extort!
